Overview of Industrial Designs/Models Registration Procedures
Industrial Designs and Models are register able with the relevant office; the Patent and Trademarks Office assesses novelty of applications.
Registration of Industrial Designs/Models is for a period of 5 years from date of filing, renewable for 2 equal 5 year periods.
Registration, assignment and cancellation of design or industrial model registrations are published in the Official Gazette and entered in the register.
Registration of Industrial Designs/Models is subject to cancellation in the event a second party requests a cancellation action before the competent tribunal on the grounds that the registrant is not the real owner of the design.
There are no current provisions in Libya as to working or compulsory licensing of industrial designs and models.
Infringements or other unauthorized use of registered industrial designs is punishable under the provisions of the Designs/Models Law; and its amendments.
